Delaware Institutes New Helmet Law

The state of Delaware has implemented a new mandatory helmet law with a bit of a novel twist. The new law went into effect on September 1, 2023. It aims to protect newly minted riders yet to gain motorcycle operating experience on Delaware’s public ways.

Previously, riders 19 years of age and older were only required to have a helmet in their possession. They did not actually have to wear one while riding. However, the state did require riders (both operator and passenger) to wear eye protection.

Experience-based helmet requirement

But now, in an interesting twist, regardless of age, riders who obtain a new motorcycle endorsement after September 1, 2023, must wear a helmet and eye protection for the first two years after obtaining that endorsement. Those who fail to comply will be subject to a civil penalty of not less than $25 nor greater than $50.

Reducing deaths and injuries

Delaware politicians suggest that SB 86, which is now law, will save lives and prevent serious head injuries. With the passing of the new law, Delaware Secretary of Transportation Nicole Majeski said:

“We know helmets save lives and prevent serious head injuries. We know a quarter of all motorcycle accidents that occurred last year involved a newly endorsed rider. By requiring this group to take extra precautions and wear a helmet we’re able to help keep Delawareans safer.”

Amy Anthony, Director of the Delaware Division of Motor Vehicles, thinks the new law will help keep riders safer, especially those with little street riding experience.

“Seeing the increase in fatalities on our roadways each week is heart-wrenching. This new law will help protect riders when they are their most vulnerable.”

Delaware’s Governor, John Carney, believes the new law is a step in the right direction as well.

“It’s our responsibility to keep Delawareans safe. This legislation, along with the current activities and protection measures, will save lives.”

Delaware’s new law and politicians suggest that requiring newly minted riders to wear a helmet will help reduce injuries and fatalities. As of August 30, 2023, there were 22,174 motorcycles registered in the state. Last year, 22 motorcyclists were killed on Delaware’s roads. Through August 31, 2023, twelve motorcyclists have lost their lives.
